Please read the following terms and conditions carefully before registering on, accessing, browsing, or using the Apexel.in website. Apexelin Private Limited, herein refered as Apexel India or Apexelin can be used unterchangbly.

Eligibility

The Apexel India Marketplace Services are not available to persons under the age of 18 or to anyone previously suspended or removed by ApexelIn from availing of the ApexelIn Marketplace Services or accessing the ApexelIn Platform. By accepting the T&Cs or by otherwise using the ApexelIn Marketplace Services on the ApexelIn Platform, you represent that you are at least 18 years of age and have not been previously suspended or removed by ApexelIn, or disqualified for any other reason, from availing the Apexel India Marketplace Services or using the ApexeIn Platform. In addition, you represent and warrant that you have the right, authority and capacity to enter into this Agreement and to abide by all the T&Cs as part of this Agreement. Finally, you shall not impersonate any person or entity, or falsely state or otherwise misrepresent your identity, age or affiliation with any person or entity. Finally, in the event of any violation of the T&Cs, Apexel India reserves the right to suspend or permanently prevent you from availing Apexel India Marketplace Services or using the ApexeIn Platform.

ELECTRONIC COMMUNICATIONS

When you visit MYCOMPANY or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on this site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

All content included on this site, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of apexelin or its content suppliers and protected by international copyright laws. The compilation of all content on this site is the exclusive property of apexelin, with copyright authorship for this collection by apexelin, and protected by international copyright laws.

REVIEWS, COMMENTS, EMAILS, AND OTHER CONTENT

Visitors may post reviews, comments, and other content: and submit suggestions, ideas, comments, questions, or other information, so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam." You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of a card or other content. apexelin reserves the right (but not the obligation) to remove or edit such content, but does not regularly review posted content. If you do post content or submit material, and unless we indicate otherwise, you grant apexelin and its associates a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. You grant apexelin and its associates and sublicensees the right to use the name that you submit in connection with such content, if they choose. You represent and warrant that you own or otherwise control all of the rights to the content that you post: that the content is accurate: that use of the content you supply does not violate this policy and will not cause injury to any person or entity: and that you will indemnify apexelin or its associates for all claims resulting from content you supply. apexelin has the right but not the obligation to monitor and edit or remove any activity or content. apexelin takes no responsibility and assumes no liability for any content posted by you or any third party.

APPLICABLE LAW

By visiting apexel.in, you agree that the laws of the country India, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and apexelin or its associates.

DISPUTES

Any dispute relating in any way to your visit to apexelin or to products you purchase through apexel.in shall be submitted to confidential arbitration in Puducherry, India, except that, to the extent you have in any manner violated or threatened to violate apexelins intellectual property rights, apexelin may seek injunctive or other appropriate relief in any state or federal court in the state of Puducherry, India, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrators award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.

SITE POLICIES, MODIFICATION, AND SEVERABILITY

Please review our other policies, such as our Shipping and Returns policy, posted on this site. These policies also govern your visit to apexelin. We reserve the right to make changes to our site, policies, and these Conditions of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

Cancellation

1. Cancellation by Apexel India: There may be certain orders that ApexeIn is unable to accept and service and these may need to be cancelled. Some situations that may result in your order being cancelled include, non-availability of the product or quantities ordered by you, non- availability of the delivery service in the address to which product is required to be shipped, inaccuracies or errors in pricing information specified by our Merchant partners, or problems identified by ApexeIn’s credit and fraud avoidance department. Apexel India may also require additional verifications or information before accepting any order. Apexel India will contact you if all or any portion of your order is cancelled or if additional information is required to accept your order. If your order is cancelled after your credit card or bank account has been charged, the said amount will be reversed back in your credit card / bank account. A promo code, once used, shall not be refunded in case of cancellation of order either by you or ApexeIn.

2. Cancellation by the User: In case of requests for order cancellations, Apexel India reserves the right to accept or reject requests for order cancellations for any reason whatsoever. As part of usual business practice, if Apexel India receives a cancellation notice and the order has not been processed/ approved by Apexel India, Apexel India shall cancel the order and refund the entire amount to you instantly. Apexel India will not be able to cancel orders that have already been partially or fully processed. Apexel India has the full right to decide whether an order has been processed or not or whether an order has been partially or fully processed. You agree not to dispute the decision made by Apexel India and accept Apexel India’s decision regarding the cancellation.

If the order is not shipped then you can cancel the order anytime.

Use of Information:

1. We may share your telephone/mobile numbers or e-mail addresses with our service providers (such as billing or collections companies) who we have contracted with Apexel India to assist us in pursuing our rights or performing our obligations under the user agreement, our policies, or any other agreement we may have with you. These service providers may also contact you using auto-dialed or pre-recorded messages calls and/or SMS or messages in any form, only as authorized by us to carry out the purposes we have identified above, and not for their own purposes.

2. By accepting the Terms here and the T&Cs in general, you accept that Apexel India may send the alerts to the mobile phone number/ email address provided by you at the time of registering for the Apexel India Service/Apexel India Platform or to any such number/e-mail address replaced and informed by you subsequently.

3. Content: While Apexel India tries to offer reliable data, ApexeIn cannot promise that the catalogues will always be accurate and up-to-date, and you agree that you will not hold our catalogue providers or us responsible for inaccuracies in the catalogues. The catalogue may include copyrighted, trademarked or other proprietary materials. You agree not to remove any copyright, proprietary or identification markings included within the catalogues or create any derivative works based on catalogue content.

Apexel India may also disclose information about you if Apexel India determines that disclosure is reasonably necessary to enforce the T&Cs or protect Apexel India’s operations or users.
